Try Before You Lease Terms & Conditions

1. THE PROMOTER

a. The Promoter is Modern Living Developments L.P. of Forum 4, Solent Business Park, Parkway South, Whiteley, Fareham, PO15 7AD (“the Promoter”).

2. TERMS

a. These standard terms and conditions (“Terms”) constitute the entire agreement between a Participant and the Promoter in relation to the “Try Before You Lease” promotion (“Promotion”).
b. By submitting a request for the Promotion, you agree to be bound by these Terms.
c. No oral statements or prior written matters not specifically incorporated herein shall have any force or effect.

3. PROMOTION PERIOD

a. The Promotion opens at 9:00am on 24 October 2025 (“Opening Date”) and closes at 11:59pm on 31 December 2025 (“Closing Date”).
b. To participate, all requirements listed in Section 4 (Eligibility) and Section 5 (Promotion Details) must be met by the Closing Date, as determined by the Promoter in its sole discretion.
c. Bookings made after the Closing Date, or which do not meet the eligibility requirements, will not qualify.
d. The Promoter will not accept responsibility for:
i. Bookings that are lost, mislaid, damaged, or delayed in transit, regardless of cause, including, for example, as a result of any technical malfunction, network, or server failure; or
ii. Proof of transmission as proof of receipt of a booking.

4. ELIGIBILITY

a. The Promotion is open to new applicants only, who have not previously been residents or licensees of Enclave: Croydon (“Property”).
b. Participants must be aged 18 or over at the time of booking.
c. Each individual may only book one (1) “Try Before You Lease” stay. Repeat or consecutive stays are not permitted.
d. The Promotion is offered on a per-person basis. Bookings made on behalf of another person will not be accepted.
e. The Promoter reserves the right to request proof of identity and eligibility.
f. The Promotion cannot be used in conjunction with any other offer or promotion.

5. PROMOTION DETAILS

a. Under the Promotion, eligible participants (“Guests”) may book a one-night stay at Enclave: Croydon at a cost of £79 (“Stay Fee”).
b. The stay will be subject to a Licence to Occupy agreement issued by the Promoter for one night only. Stays cannot be extended beyond the agreed one-night period under any circumstances.
c. Guests must bring their own bedding, towels, and personal items. The apartment will be provided in a clean and serviceable condition but without linens or consumables.
d. Guests must leave the apartment in the same clean and serviceable condition as it was provided. Any damage, breakages, or loss caused during the stay (beyond fair wear and tear) will be the responsibility of the Guest. The Promoter reserves the right to recover the reasonable cost of repair or replacement for any such damage or loss.
e. Following the stay, should the Guest proceed to sign a Tenancy Agreement for a qualifying apartment at Enclave: Croydon, the £79 Stay Fee will be credited against the first month’s rent.
f. The credit is non-transferable and will only apply if the tenancy is signed within 30 days of the “Try Before You Lease” stay.
g. Guests who do not proceed with a tenancy will not be entitled to any refund of the Stay Fee.
h. Participation in the Promotion and/or completion of a “Try Before You Lease” stay does not guarantee the availability of any particular apartment or tenancy offer.
i. Guests are responsible for their own travel, insurance, food, and any other personal expenses incurred during the stay.

6. PARTICIPATING PROPERTY

Enclave: Croydon
All apartment types are eligible for the Promotion, subject to availability.

7. LIMITATION OF LIABILITY

a. Insofar as is permitted by law, the Promoter, its agents, or distributors will not be responsible or liable to compensate any participant, or accept any liability for any loss, damage, personal injury, or death arising out of or in connection with participation in this Promotion, except where caused by the negligence of the Promoter or its employees.
b. Your statutory rights are not affected.
c. The Promoter accepts no responsibility for disappointment of any kind suffered by any participant as a result of taking part in the Promotion or not qualifying for a tenancy.

8. GENERAL

a. The Promoter reserves the right to disqualify any participant if it has reasonable grounds to believe that they have breached these Terms or any applicable law.
b. The Promoter reserves the right to cancel or amend the Promotion and/or these Terms without notice where necessary due to circumstances beyond its reasonable control. Any changes will be posted at www.enclave.com/croydon.
c. The Promotion is subject to limited availability and operates on a first-come, first-served basis.
d. The £79 Stay Fee and any rent credit are non-transferable and non-refundable, except at the sole discretion of the Promoter.
e. These Terms and any dispute or claim arising out of or in connection with them shall be governed by the laws of England and Wales.
f. The courts of England shall have exclusive jurisdiction over any such dispute or claim.
